Terms of Service
Last updated: November 3, 2025
1. Agreement
These Terms govern use of higeorge.org and the HiGeorge AI bookkeeping platform, together called the "Service," operated by HiGeorge, Inc. ("the Company," "we," "us," or "our"), a corporation located at 600 Congress Avenue, Suite 1400, Austin, TX 78701. Using or accessing the Service means you accept these Terms. If you disagree, do not use it.
HiGeorge offers AI bookkeeping software that connects to bank accounts in read-only mode, categorizes transactions, reconciles accounts, and creates financial reports. These Terms apply to that purpose.
2. Use of the Service
- You must be 18 or older, unless a parent or legal guardian consents to your use of the Service.
- You may not use the Service unlawfully, disrupt its operation, or seek unauthorized access to systems or data.
- Except as applicable law allows, you may not scrape, reverse-engineer, or copy the Service.
3. Intellectual Property
The Company or its licensors own the Service, including its text, graphics, logos, and software, which intellectual-property laws in the U.S. and elsewhere protect. We give you a limited, non-exclusive, non-transferable license to use the Service for managing your business bookkeeping as intended.
4. Financial Data Authorization and Service Scope
By linking a bank account to HiGeorge, you authorize the Company to obtain your financial institution's data in read-only mode, solely to retrieve transaction history, balances, and account identifiers for the bookkeeping service you subscribed to.
This authorization lets the Company neither initiate transfers nor write to your account, and does not allow use of your financial data beyond providing bookkeeping reports and exports. Your financial data remains yours. You can disconnect your bank account or export your transaction history at any time.
No financial, tax, or accounting advice. HiGeorge provides bookkeeping software, not services from a licensed accounting firm, certified public accountant, or tax advisor. Automated software creates the Service's transaction categorizations, profit-and-loss reports, and year-end exports as organizational tools. They are not professional accounting opinions, tax advice, tax filings, or audit services. You alone are responsible for accurate books and for satisfying your business's tax obligations. We recommend having a qualified tax professional review your records before filing.
You are accountable for information submitted through the Service. You represent that you hold the rights and authorizations needed to link your bank accounts and share content with us. You license the Company to process, store, and use your data as needed to provide the Service.
5. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRANSACTION CATEGORIZATIONS AND FINANCIAL REPORTS ARE GENERATED BY AUTOMATED SOFTWARE AND MAY CONTAIN ERRORS; THEY ARE NOT GUARANTEED TO BE COMPLETE, ACCURATE, OR SUITABLE FOR ANY SPECIFIC TAX OR LEGAL PURPOSE.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON TRANSACTION CATEGORIZATIONS OR FINANCIAL REPORTS FOR TAX OR LEGAL PURPOSES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.
7. Indemnification
You agree to defend, indemnify, and hold harmless the Company from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.
8. Termination
We may suspend or end your Service access at any time, with or without notice, for any reason, including a breach of these Terms. Termination ends your access rights. Provisions that should naturally continue will do so, including Sections 3, 5, 6, 7, 9, and 10.
9. Governing Law; Dispute Resolution
Texas law governs these Terms, excluding its conflict-of-law rules.
Informal Resolution. Before filing a claim, contact us at [email protected] and try to resolve it informally for at least 60 days.
Arbitration. Any dispute that cannot be resolved informally will be settled by binding arbitration administered in Texas, USA under the rules of the American Arbitration Association ("AAA"). Judgment on the arbitrator's award may be entered in any court of competent jurisdiction. You and the Company each waive the right to a jury trial and the right to participate in a class action.
Exception. Either party may request injunctive relief from a court of competent jurisdiction in Texas, USA, for intellectual-property infringement or unauthorized Service access.
10. Changes to These Terms
We may revise these Terms periodically. We will post material changes with a new "Last updated" date. Continuing to use the Service after the revised Terms take effect means you accept them.
